By accessing or using Mixstream's platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Mixstream.

If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

Mixstream is a music platform that enables artists, labels, and rights holders to release, distribute, license, and monetize their music end-to-end. Our services include:

• Direct distribution to major streaming platforms
• Sync licensing for brands, creators, and platforms
• Rights and royalty management on a transparent ledger
• Real-time analytics across every channel
• AI-assisted release and workflow tools

3.1 Content Ownership

You retain all ownership rights to your music and content uploaded to Mixstream. By using our services, you grant us a limited, non-exclusive license to distribute, promote, and process your content as necessary to provide our services.

3.2 Content Requirements

You represent and warrant that:

• You own all rights to the content you upload
• Your content doesn't infringe on third-party rights
• You have all necessary permissions and clearances
• Your content complies with all applicable laws

3.3 Prohibited Uses

You agree not to:

• Upload copyrighted content without proper authorization
• Use our platform for illegal or fraudulent activities
• Attempt to manipulate streaming or download counts
• Reverse engineer or compromise our systems
• Harass or harm other users

4.1 Revenue Share

Mixstream retains a transparent percentage of net revenues generated from your content. Specific rates depend on your subscription tier and are disclosed in your account dashboard before any release goes live.

4.2 Payment Schedule

Payments are processed on a regular cadence once eligible balances clear from the originating platforms. Smaller balances roll over until the minimum threshold is met. All payments are subject to applicable taxes and processing fees.

4.3 Subscription Fees

Subscription fees, where applicable, are billed monthly or annually as selected. All fees are non-refundable except as required by law. You may cancel at any time.

Mixstream respects intellectual property rights. We respond promptly to valid DMCA takedown notices and may terminate accounts of repeat infringers. See our DMCA Policy for details.

Our platform, technology, and branding remain the exclusive property of Mixstream. Users are granted a limited license to use our services for their intended purpose.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference into these terms.

We implement industry-standard security measures to protect your data and comply with applicable privacy laws including GDPR and CCPA.

Mixstream provides services "as is" without warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the preceding 12 months.

We are not responsible for third-party platform policies, technical issues, or market performance of your content.

Either party may terminate this agreement at any time. Upon termination, we will cease distributing your content and pay any outstanding royalties within 60 days.

Content removal from platforms may take 30–90 days depending on each platform's policies.

These terms are governed by the laws of California, United States. Any disputes will be resolved through binding arbitration in Palo Alto, CA.

We may update these terms periodically. Significant changes will be communicated via email and posted on our platform. Continued use after changes constitutes acceptance.
