DMCA Overview

Mixstream is committed to respecting the intellectual property rights of others and expects users of our platform to do the same. The Digital Millennium Copyright Act (DMCA) provides a framework for copyright owners to notify online service providers about alleged infringement.

If you believe that material available on Mixstream infringes your copyright, you may submit a takedown notice. We respond promptly to valid notices and may remove or disable access to the allegedly infringing material.

Filing a Takedown Notice

To submit a DMCA takedown notice, send a written notification to our designated agent containing the following:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, with enough detail to locate it on Mixstream
  • Your contact information (address, telephone number, email)
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on its behalf

Counter-Notification

If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification with the following:

  • Your physical or electronic signature
  • Identification of the material that has been removed and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the US, any judicial district in which Mixstream may be found) and that you will accept service of process from the original complainant or their agent

Upon receipt of a valid counter-notification, we may reinstate the material in 10 to 14 business days unless the original complainant files an action seeking a court order.

Repeat Infringers

In accordance with the DMCA and other applicable law, Mixstream has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

We may also at our sole discretion limit access to the platform and/or terminate accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

False Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that it was removed or disabled by mistake or misidentification, may be liable for damages.

Do not submit a takedown notice or counter-notification unless you are certain you have the legal right to do so. When in doubt, consult an attorney before filing.
